(FreedomBeacon.com)- Last Thursday, former President Donald Trump asked the US Supreme Court to block the release of records sought by the select committee investigating the January 6 riot at the Capitol.
In October, the Biden White House sent a letter to the National Archives authorizing it to release the documents to the committee. In the letter, Biden’s White House Counsel Dana Remus wrote that President Biden determined that the assertion of Executive Privilege in this instance is not in the best interests of the United States, concluding that it is not justified concerning any of the documents requested.
President Trump sued to prevent the National Archives from acting on the White House’s authorization. And in November, DC District Court Judge Tanya Chutkan ruled that Trump could not prevent the release, arguing that Trump wouldn’t acknowledge the “deference owed” to Biden’s decision. “Presidents are not kings,” Chutkan said in her ruling, adding that the plaintiff is no longer the president. So Trump filed an appeal.
Two weeks ago, a three-judge panel for the US Court of Appeals for the District of Columbia ruled that the former president had no basis to override President Biden’s decision to allow the release of the documents subpoenaed. The court gave Trump fourteen days to file an emergency request with the Supreme Court.
In response to the President’s emergency request to the Court, the January 6 select committee submitted its filing to the Court arguing that the delays in getting the documents requested “would inflict a serious injury on the Select Committee and the public.”
Trump has every legal right to fight the subpoena in court. It isn’t “injury” that concerns the select committee; it is time. The January 6 committee will have to fold up its circus tent and go away when the new Congress is sworn in in January 2023.
In its filing, the select committee also argued that Trump’s records were crucial in shaping “the direction of the investigation.”
That too is nonsense.
The reality is, the select committee has a predetermined conclusion – namely, that Donald Trump is responsible for the riot. The direction of the investigation has already been shaped.
